Copyright & Content Complaints
Last updated: August 29, 2026
1. Scope of This Policy
Sissy Cloud hosts audio files uploaded by its users. We do not review uploads before they are published, and we do not claim ownership of user content. We respect the intellectual property rights of others and expect our users to do the same.
This page is the route for two kinds of complaint:
- Copyright complaints — material on Sissy Cloud that infringes your copyright (sections 2 to 6).
- Other illegal content — anything else you believe is unlawful (section 7).
Uploading content you do not have the rights to is a breach of our Terms of Service.
2. Before You Send a Notice
Please consider the following first:
- Check whether the use is actually licensed or otherwise permitted. Depending on your jurisdiction, quotation, parody, review, or fair use may allow the material to stay up.
- Only the rights holder or someone authorised to act on their behalf may submit a copyright notice.
- We forward notices to the uploader, including your name and contact details. Do not include information you are not willing to share with them.
- Knowingly misrepresenting that material is infringing can make you liable for damages, including costs and legal fees, under 17 U.S.C. § 512(f) and comparable provisions elsewhere.
3. Submitting a Copyright Notice
To be effective, a notice must be in writing and include all of the following. This mirrors the requirements of 17 U.S.C. § 512(c)(3)(A) of the United States Digital Millennium Copyright Act (DMCA), which we follow as our standard process worldwide.
- A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list of those works.
- Identification of the material you claim is infringing, with the exact URL of each item (for example https://sissycloud.com/track/…), so that we can locate it. A notice that does not identify specific material cannot be acted on.
- Your contact details: full name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on their behalf.
4. Copyright Contact
Send notices and counter-notices to:
Email: info@sissycloud.com
Email is the fastest route and is our preferred channel. Please put Copyright Notice in the subject line.
5. What Happens After We Receive a Notice
- We confirm receipt of your notice.
- If the notice is complete and appears valid, we expeditiously remove or disable access to the material.
- We notify the user who uploaded it, provide them with a copy of the notice, and tell them why their content was removed.
- If the notice is incomplete, we tell you what is missing so you can resubmit. We cannot act on notices that do not identify specific material.
- Repeated or serious infringement is recorded against the uploading account (see section 8).
We act without undue delay, but we are a small service and cannot guarantee a fixed response time.
6. Counter-Notification
If your content was removed and you believe this was a mistake or a misidentification, you may send us a counter-notification. Following 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your full name, postal address, and telephone number.
- A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located, or — if your address is outside the United States — any judicial district in which Sissy Cloud may be found, and that you will accept service of process from the person who submitted the original notice.
We forward valid counter-notifications to the original complainant. If they do not notify us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.
7. Reporting Other Illegal Content
Anyone may report content on Sissy Cloud they consider illegal, not only copyright holders. This mechanism is provided in line with Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065). Send reports to the same address in section 4, with Illegal Content Report in the subject line.
What to include
- A sufficiently substantiated explanation of why you consider the content illegal.
- The exact URL, and any further information needed to find it.
- Your name and email address, unless the report concerns material relating to child sexual abuse or certain other offences, where you may report anonymously.
- A statement confirming your good-faith belief that the information in the report is accurate and complete.
How we handle it
We confirm receipt without undue delay and decide in a timely, diligent, non-arbitrary and objective manner. We inform you of our decision. Where we remove or restrict content, we provide the affected user with a statement of reasons in accordance with Article 17 of the Digital Services Act, explaining what we did, on what grounds, and how they can contest it.
8. Repeat Infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the rights of others. Accounts that are the subject of repeated valid notices may have their content removed, their upload ability withdrawn, or their account terminated without refund of any subscription.
9. Misuse of This Process
Takedown notices are not a way to settle unrelated disputes. Where a person or organisation frequently submits notices or reports that are manifestly unfounded, we may suspend processing of their submissions for a reasonable period, after issuing a prior warning, in line with Article 23 of the Digital Services Act.
10. Trademark and Other Rights
Complaints about trademarks, rights of publicity, personality rights, defamation, or privacy — including a recording of your voice published without your consent — go to the same contact in section 4. Describe the right you hold, identify the material by URL, and explain the infringement.
11. Applicable Law
Sissy Cloud is operated from Switzerland and its operation is governed by Swiss law. Swiss law does not provide a statutory notice-and-takedown procedure or a hosting safe harbour comparable to the DMCA. We therefore operate the process described on this page voluntarily, alongside the United States and European Union procedures referred to above, because we think it is the right way to handle these complaints.
Using this process does not waive any right or remedy available to you, to us, or to our users, and nothing here constitutes an admission of liability. We may update this policy; the date at the top of this page reflects the current version.
